Common use of Trustee’s Powers Clause in Contracts

Trustee’s Powers. At any time, or from time to time, without liability therefor and without notice, upon written request of the Beneficiary and presentation of this Deed of Trust, and without affecting the personal liability of any person for payment of the Indebtedness secured hereby or the effect of this Deed of Trust upon the remainder of the Mortgaged Property, the Trustee may (1) reconvey any part of the Mortgaged Property, (2) consent in writing to the making of any map or plat thereof, (3) join in granting any easement therein, or (4) join in any extension agreement or any agreement subordinating the lien or charge hereof.

Trustee’s Powers. At any time, or from time to time, without liability therefor and without notice, upon written request of the Beneficiary and presentation of this Deed of Trust, and without affecting the personal liability of any person for payment of the Indebtedness secured hereby Secured Obligations or the effect of this Deed of Trust upon the remainder of said Trust Estate, Trustee may, subject to the Mortgaged Property, terms and conditions of the Trustee may Ground Lease: (1a) reconvey any part of the Mortgaged Propertysaid Trust Estate, (2b) consent in writing to the making of any map or plat thereof, (3c) join in granting any easement thereinthereon, or (4d) join in any extension agreement or any agreement subordinating the lien or charge hereof.

Trustee’s Powers. At any time, or from time to time, without liability therefor therefor, and without notice, upon written request of the Beneficiary and presentation of this Deed of Trust, and without affecting the personal liability of any person for payment of the Indebtedness indebtedness secured hereby or the effect of this Deed of Trust upon the remainder of the Mortgaged Propertysaid Trust Estate, the Trustee may may, (1i) reconvey any part of the Mortgaged Property, said Trust Estate; (2ii) consent in writing to the making of any map or plat thereof, ; or (3iii) join in granting any easement therein, or (4) join in creating any extension agreement restriction affecting this Deed of Trust or any agreement subordinating the lien or charge hereof, subject to the rights of Bondholders under the Indenture.

At any time, or from time to time, without liability therefor therefor, and without notice, upon written request of the Beneficiary and presentation of this Deed of Trust, and without affecting the personal liability of any person for payment of the Indebtedness indebtedness secured hereby or the effect of this Deed of Trust upon the remainder of the Mortgaged Propertysaid Trust Estate, the Trustee may (1i) reconvey any part of the Mortgaged Property, said Trust Estate; (2ii) consent in writing to the making of any map or plat thereof, ; or (3iii) join in granting any easement therein, or (4) join in creating any extension agreement restriction affecting this Deed of Trust or any agreement subordinating the lien or charge hereof.

Trustee’s Powers. At any time, or from time to time, without liability therefor and without notice, upon written request of the Beneficiary and presentation of this Deed of TrustTrust and the Note secured hereby for endorsement, and without affecting the personal liability of any person for payment of the Indebtedness secured hereby or the effect of this Deed of Trust upon the remainder of the Mortgaged PropertyTrust Estate, the Trustee may (1i) release or reconvey any part of the Mortgaged PropertyTrust Estate, (2ii) consent in writing to the making recording of any map or plat thereof, (3iii) join in granting any easement thereinwith respect to the Trust Estate, (iv) or (4) join in any extension agreement or any agreement subordinating the lien or charge hereof.

Trustee’s Powers. At any time, or from time to time, without liability therefor and without notice, upon written request of the Beneficiary and presentation of this Deed of TrustTrust and the Notes for endorsement, and without affecting the personal liability of any person for payment of all or any portion of the Indebtedness indebtedness secured hereby or the effect of this Deed of Trust upon the remainder of the Mortgaged Property, the Trustee may (1) may: reconvey any part of the Mortgaged Property, (2) ; consent in writing to the making of any map or plat thereof, (3) ; join in granting any easement therein, thereon; or (4) join in any extension agreement or any agreement subordinating the lien or charge hereof.
