TWENTY-SIXTH. In this act, the LESSEE party, in performance bond of this contract, and without prejudice of the obligation to respond with all its patrimony, undertakes to the payment as a deposit, the amount of ELEVEN THOUSAND FIVE HUNDRED PESOS ($11,500.-) to the LESSOR, amount that shall not accrue interests or been applied for rent payment. Once the lease have finished and the PROPERTY is returned in the same conditions it was received, except for the wearing effects of time and being paid all services and accepted by the LESSOR, the devolution of such deposit shall be done in the same currency after the pertinent deductions, if any.- The deposit should be updated any time the rent amount is modified, as per stipulations of clause 29.

TWENTY-SIXTH. In the event the City is providing grant funding hereunder, the Contractor acknowledges and agrees that it has reviewed the applicable grant agreement and any other relevant documents (together the “Grant”). Contractor agrees to, and will cause any subcontractors or other agents under its control to agree to, comply with all applicable Grant requirements, including without limitation all rules and regulations promulgated in furtherance thereof. The Contractor further agrees to supply such information and reports as the City may request. Contractor will, upon request, provide access to the City or such other agency administering the Grant, to examine all relevant books, records, documents or electronic data of the Contractor necessary to review Contractor’s compliance. Contractor shall cause its subcontractor(s) and agent(s) to comply with the terms hereof. Any term or condition required by the Grant to be set forth herein, to the extent it is not set forth is deemed incorporated herein by reference. Contractor hereby certifies that neither it, nor its subcontractor(s), are not debarred or suspended, or otherwise excluded from or ineligible to receive said Grant funding.

TWENTY-SIXTH. All of the terms, covenants and conditions of this lease shall inure to the benefit of and be binding upon the respective heirs, executors, administrators, successors and assigns of the parties hereto. However, in the event of the death of the Tenant, if an individual, the Landlord may, at its option. terminate this lease by notifying the executor or administrator of the Tenant at the demised premises.
TWENTY-SIXTH. If there now is or shall be installed in said building a "sprinkler system" the Tenant agrees to keep the appliances thereto in the demised premises in repair and good working condition, and if the New York Board of Fire Underwriters or the New York Fire Insurance Exchange or any bureau, department or official of the State or local government requires or recommends that any changes, modifications, alterations or additional sprinkler heads or other equipment be made or supplied by reason of the Tenant's business, or the location of partitions, trade fixtures, or other contents of the demised premises, or if such changes, modifications, alterations, additional sprinkler heads or other equipment in the demised premises are necessary to prevent the imposition of a penalty or charge against the full allowance for a sprinkler system in the fire insurance rate as fixed by said Exchange, or by any Fire Insurance Company the Tenant will at the Tenant's own expense, promptly make and supply such changes, modifications, alterations, additional sprinkler heads or other equipment. As additional rent hereunder the Tenant will pay to the Landlord, annually in advance, throughout the term $_________________________, toward the contract price for sprinkler supervisory service.
TWENTY-SIXTH. (DOMICILE) This trust shall be domiciled on the sixth floor of the Edificio Fiduciario, located at 200 Via Espana, Panama, Republic of Panama, which is THE FIDUCIARY’S domicile.

  • FIFTH The Distributor shall act as an agent of the Company in connection with the sale and redemption of Shares. Except with respect to such sales and redemptions, the Distributor shall act as principal in all matters relating to the promotion of the sale of Shares and shall enter into all of its own engagements, agreements and contracts as principal on its own account. The Distributor shall enter into agreements with investment dealers and financial institutions selected by the Distributor, authorizing such investment dealers and financial institutions to offer and sell the Shares to the public upon the terms and conditions set forth therein, which shall not be inconsistent with the provisions of this Agreement. Each agreement shall provide that the investment dealer or financial institution shall act as a principal, and not as an agent, of the Company.

  • SIXTH Meetings of stockholders may be held within or without the State of Delaware, as the By-Laws may provide. The books of the Corporation may be kept (subject to any provision contained in the DGCL) outside the State of Delaware at such place or places as may be designated from time to time by the Board of Directors or in the By-Laws of the Corporation.

  • SEVENTH A copy of the Agreement of Merger will be furnished by the surviving corporation on request, without cost, to any stockholder of the constituent corporations.
