Common use of Umbrella Liability Insurance or Excess Clause in Contracts

Umbrella Liability Insurance or Excess. Liability Insurance shall not be less than $5,000,000.00 each occurrence and aggregate. Coverage shall be excess of the Employers Liability, Commercial General Liability and Automobile Liability coverages required herein and shall include all coverages on a “following form” basis. Coverage shall drop down as primary on the exhaustion of any aggregate limit. The aggregate limits shall apply separately to the Contract, and the specific contract aggregate limits shall be evidenced by the use of an endorsement approved by Owner. The insurance company shall waive all claims rights, including all rights of subrogation, against Owner and Owner’s officers and employees.
