Unelected Interests. Placement in the Public Domain The Parties and the Facility Operator each agree that either may place any Subject Invention in the public domain (by inclusion in the final report of this project): i. that is not elected by either Party pursuant to this Exhibit; ii. for which each Party fails to have a patent application filed in that country on a Subject Invention or decides not to pay any maintenance fees covering such Subject Invention; and iii. for which neither Party nor the Government desires to retain title at any time.
