Unfunded Amounts. Notwithstanding anything contained in this Agreement to the contrary, the Parties agree that the Operator shall have no obligation to incur or make any expenditures under this Agreement (other than those costs for which the Operator is liable pursuant to Sections 7.1, 7.2 and 7.3 hereof) to the extent such costs or expenditures are not included in a Budget approved by the Operator.
Unfunded Amounts. Notwithstanding anything contained in this Agreement to the contrary, the Parties acknowledge and agree that the Service Provider shall have no obligation or responsibility to incur or pay any costs or make expenditures in providing Operations Services hereunder (other than those costs for which the Service Provider is liable pursuant to Sections 7.1, 7.2 and 7.3 hereof) (i) that are not Pass-Through Expenditures or (ii) to the extent such costs or expenditures are not Budgeted or funds to pay such costs or expenditures are not available for withdrawal by the Service Provider from the Operating Account or the Storm Reserve, as applicable.
