Common use of Unsafe Work Clause in Contracts

Unsafe Work. No employee shall be disciplined for refusal to work on an assignment which, in the opinion of: (a) a member of the Occupational Safety and Health Committee, or (b) a person designated by an occupational safety and health committee, or (c) a xxxxxxx at a worksite where there is no occupational safety and health committee, after an onsite inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers Compensation Act. Where an employee acts in compliance with Section 3.24 of the Workers' Compensation Board Industrial Health and Safety Regulations, she shall not be subject to disciplinary action.
