Common use of Unsecured Creditor Remedies Clause in Contracts

Unsecured Creditor Remedies. Except as set forth in Sections 2.2, 3.6, and 6, the Agents and the other Claimholders may exercise rights and remedies as unsecured creditors generally against any Grantor in accordance with the terms of the applicable Loan Documents and applicable law so long as doing so is not in contravention of the terms of this Agreement; provided, that in the event that any Claimholder becomes a judgment Lien creditor in respect of Collateral as a result of its enforcement of its rights as an unsecured creditor with respect to its Debt, such judgment Lien shall be subject to the terms of this Agreement for all purposes as the other Liens securing such Debt.

Except as set forth in Sections 2.23.1 and 3.5, 3.6ABL Agent, ABL Claimholders, Term Agent and 6, the Agents and the other Term Loan Claimholders may exercise rights and remedies as unsecured creditors generally against any Grantor in accordance with the terms of the applicable ABL Loan Documents Documents, Term Loan Documents, as applicable, and applicable law so long as doing so is not in contravention of the terms of this Agreementlaw; provided, however, that in the event that any Claimholder becomes a judgment Lien creditor in respect of Collateral as a result of its enforcement of its rights as an unsecured creditor with respect to its Debtthe Obligations, such judgment Lien shall be subject to the terms of this Agreement for all purposes as the other Liens securing such Debtthe Obligations.
