Up Agreements. Each member of a Group acknowledges that during the course of the Pre-Existing Agreements and the Follow-Up Agreements, the members of the other Group have acquired or may acquire certain know-how which is not Confidential Information of a member of the first Group under the Pre-Existing Agreements or a Follow-Up Agreement. Nothing in this Agreement, the Pre-Existing Agreements or the Follow-Up Agreements shall be construed to prevent the use of such know-how by the other Group during or after the term of the Follow- Up Agreements.
