Common use of Upon Disability, Death or Without Cause Clause in Contracts

Upon Disability, Death or Without Cause. At the election of the Company, Employee’s employment may be terminated: (A) should Employee become physically or mentally unable to perform his duties for the Company hereunder and such incapacity has continued for a total of ninety consecutive days or for any one hundred eighty days in a period of three hundred sixty-five consecutive days (a “Disability”); (B) upon Employee’s death (“Death”); or (C) upon written notice to Employee for any other reason or for no reason at all.

Upon Disability, Death or Without Cause. At the election of the Company, Employee’s employment may be terminated: (A) should Employee become physically have a physical or mentally mental impairment that substantially limits a major life activity and Employee is unable to perform the essential functions of his duties for the Company hereunder and such incapacity has continued for a total of ninety consecutive days job with or for any one hundred eighty days in a period of three hundred sixty-five consecutive days without reasonable accommodation (a “Disability”); (B) upon Employee’s death (“Death”)death; or (C) upon with thirty (30) days prior written notice to Employee notice, at any time Without Cause for any other reason or for no reason at allreason.
