Common use of Upon Early Settlement of Purchase Contracts Clause in Contracts

Upon Early Settlement of Purchase Contracts. by a Holder of the related Securities, the Company shall issue, and the Holder shall be entitled to receive, 0.6148 shares of Common Stock on account of each Purchase Contract as to which Early Settlement is effected (the "Early Settlement Rate"). The Early Settlement Rate shall be adjusted in the same manner and at the same time as the Settlement Rate is adjusted. Computations and notices with respect to any such adjustments shall be made and given, respectively, as provided in Section 5.7 relating to Settlement Rate adjustments.

Upon Early Settlement of Purchase Contracts. by a Holder of the related SecuritiesPIES, the Company shall issue, and the Holder shall be entitled to receive, 0.6148 3.0084 shares of Common Stock Stock, subject to adjustment in the same manner and at the same time as the Settlement Rate is adjusted pursuant to Section 5.5, on account of each Purchase Contract as to which Early Settlement is effected (the "Early Settlement Rate").
