Upstream’s Responsibility. Upstream shall have the right, at its sole expense, to enforce the Supported Patent Rights against an Infringement II outside Japan, except any procedures which require to be filed by the patentee under applicable law or by the court. Notwithstanding the foregoing, Upstream shall consider in good faith the interests of ▇▇▇▇▇▇ in so doing. Maruho shall assist Upstream (upon Upstream’s request and at Upstream’s sole expense) to the extent commercially reasonable in connection therewith.
