Use and Development. Subject to and conditioned to Your continuous compliance with this Agreement and payment of the applicable fees for the Product, if any, Chaos grants You non-exclusive, Internal Use, non-sublicensable, non-transferable (except if permitted by applicable law), revocable right and license to access the SDK, or any part of it, for development, research and other internal purposes only, to: Use the SDK or any part of it “AS IS”; and/or create Licensee's Works; and/or link to Licensee's Works and/or any other software, software applications, products, projects, services, solutions of Yours; and/or
Use and Development. a. Use the SDK or any part of it “AS IS”; and/or
b. create Licensee's Works; and/or
c. link to Licensee's Works and/or any other software, software applications, products, projects, services, solutions of Yours; and/or
d. make copies of the SDK only as necessary to perform an activity permitted under this Agreement and You keep all copyright notices and other marks of ownership on each copy, or partial copy, of the SDK. Any copies or partial copies of the SDK are for Your Internal Use only and cannot be provided to any third parties, unless othwerwise stipulated in Your Additional Agreement. You agree to delete all copies of the SDK when they are no longer required for the purpose they were created for. You may not Use the SDK or Licensee's Works for commercial purposes, unless a specific agreement with Chaos is reached on that. "Commercial Purposes" means, not limited to: sell, charge, accept payment in any form or other compensation for the usage of the SDK, Licensee's Works or any parts thereof produced with the SDK.
Use and Development. The Ruakura land forms part of the area transferred from Waikato District Council to ▇▇▇▇▇▇▇▇ City Council jurisdiction specifically to enable its urbanisation. The urbanisation of this land has been identified in a number of strategic documents including; The Hamilton Urban Growth Strategy, Futureproof and the Proposed Waikato Regional Policy Statement. The Proposed Waikato Regional Policy Statement not only identifies Ruakura as an Industrial Growth Node but also allocates 405 ha of development to this area and sets a time table for staged land release. These elements of the Proposed Waikato Regional Policy Statement are beyond challenge and are statutory requirements. Significant publically funded infrastructure transverses the site this includes the proposed Waikato Expressway and the East Coast Main Trunk Line. The E1 Arterial also directly adjoins the site. The location of this important infrastructure is a key driver in the form of the efficient urbanisation of the land. A detailed structure plan process has now been adopted by the ▇▇▇▇▇▇▇▇ City Council and notified with the Proposed District Plan. This structure plan process looked at the key attributes of the land and how these could best be incorporated into a large nationally significant urban expansion for Hamilton. The Ruakura Schedule is intended to enable core elements of the development proposal and is consistent with the adopted structured plan. These provisions will eventually be superseded by the provisions of the proposed Hamilton District Plan once this document becomes progressively operative.

Use and Development. Summit will warrant the Summit Software to ------------------- Participants in accordance with Summit's then standard end user warranties. Summit also warrants to Lilly that the Summit Software and ROD shall be developed and implemented in accordance with prevailing professional standards and using current state-of-the-art technology and security systems.

Use and Development. The PROPERTY annexed shall be used or developed in general conformity with TOWN comprehensive and master plans, subdivision regulations, zoning code, building codes and other applicable statutory and local requirements. The TOWN and the ANNEXOR agree that such plans, regulations, codes and other statutory and local requirements are directly related to and generated by development intended to occur within the PROPERTY and that no taking thereby will occur requiring any compensation.
Use and Development. Concessionaire would provide to NHAI a video recording covering the status and progress of construction works within seven days of the appointed date and thereafter close of each quarter.
