Common use of Use of Confidential Information During Employment Clause in Contracts

Use of Confidential Information During Employment. Except as may be required of Executive to perform his job duties, Executive further agrees that in the course of his Company employment, Executive will not (i) remove from any Company or TCB office any documents, electronically stored information, or related items that contain Confidential Information, including, without limitation, computer discs, recordings, or other storage or archival systems or devices, including copies; or (ii) place or save any Confidential Information on any computer or electronic storage system that is not Company or TCB property. All Confidential Information, and all memoranda, notes, records, drawings, documents, or other writings whatsoever made, compiled, acquired, or received by Executive at any time during his employment with the Company, including during the term of this Agreement, arising out of, in connection with, or related to any Company or TCB activity or business, including, without limitation, the customers, vendors, third parties, or others with whom the Company has a business relationship, the arrangements of the Company with such parties, and the pricing and expansion policies and strategy of the Company, are, and shall continue to be, the Company’s and TCB’s sole and exclusive property.
