Common use of USE OF CONSTRUCTION CONTINGENCY Clause in Contracts

USE OF CONSTRUCTION CONTINGENCY. The amount for contingencies ("Contingency"), if any, is set forth in the Guaranteed Maximum Price breakdown. CM/GC shall notify Owner in writing at least three (3) days prior to any proposed use of the Contingency, or any portion thereof, and shall supply Owner with detailed information relative to such proposed use. CM/GC shall not use any portion of the Contingency without Owner’s prior written approval, which approval shall not be unreasonably withheld.
