Common use of Use of Non-AP1000 Reactor Technology Clause in Contracts

Use of Non-AP1000 Reactor Technology. The Borrower shall not construct, or permit to be constructed, any nuclear reactor for the Project other than Westinghouse AP1000 standard nuclear reactor plant design, certified at 76 Fed. Reg. 82,079 (Dec. 30, 2011) (codified at 10 C.F.R. Part 52 Appendix D), and any amendments thereto, as described in each COL, including any amendments to the COLs or exemptions issued by NRC approving modifications to such certified standard design.
