Common use of Use of Other Data Clause in Contracts

Use of Other Data. Notwithstanding the foregoing, nothing in this Agreement will restrict: (a) Licensor’s use of System Data or data derived from System Data that does not identify or permit, alone or in conjunction with other data, identification, association, or correlation of or with (i) Buyer, its Affiliates, Users, customers, suppliers or other persons interacting with Buyer and its Affiliates or any Confidential Information of Buyer, or (ii) any device (e.g. computer, mobile telephone, or browser) used to access or use the Software as originating through Buyer or its Affiliates or interacting with Buyer or its Affiliates; or (b) either Party’s use of any data, records, files, content or other information related to any third party that is collected, received, stored or maintained by a Party independently from this Agreement.

Use of Other Data. Notwithstanding the foregoing, nothing in this Agreement will restrict: (a) Licensor’s use of System Data or data derived from System Data that does not identify or permit, alone or in conjunction with other data, identification, association, or correlation of or with (i) Buyer, its Affiliates, Users, customers, suppliers or other persons interacting with Buyer and its Affiliates or any Confidential Information of Buyer, or (ii) any device (e.g. computer, mobile telephone, or browser) used to access or use the Software Product as originating through Buyer or its Affiliates or interacting with Buyer or its Affiliates; or (b) either Party’s use of any data, records, files, content or other information related to any third party that is collected, received, stored or maintained by a Party independently from this Agreement.

Use of Other Data. Notwithstanding the foregoing, nothing in this Agreement will restrict: (a) LicensorSeller’s use of System Data or statistics and aggregate data derived from System Data that where the derived data does not identify or permit, alone or in conjunction with other data, identification, association, or correlation of or with (i) Buyer, its Affiliates, Users, customers, suppliers or other persons interacting with Buyer and its Affiliates or any Confidential Information of Buyer, Affiliates; or (ii) any device (e.g. computer, mobile telephone, or browser) used to access or use the Software as originating through Buyer or its Affiliates or interacting with Buyer or its Affiliates; or (b) either Party’s use of any data, records, files, content or other information related to any third party that is collected, received, stored or maintained by a Party independently from this Agreement.

Notwithstanding the foregoing, nothing in this Agreement will restrict: (a) Licensor’s IPC GLOBAL SERVICES’ use of System Data or data derived from System Data that does not identify or permit, alone or in conjunction with other data, identification, association, or correlation of or with (i) Buyer, its Affiliates, Users, customers, suppliers or other persons interacting with Buyer and its Affiliates or any Confidential Information of Buyer, or (ii) any device (e.g. computer, mobile telephone, or browser) used to access or use the Software as originating through Buyer or its Affiliates or interacting with Buyer or its Affiliates; or (b) either Party’s use of any data, records, files, content or other information related to any third party that is collected, received, stored or maintained by a Party independently from this Agreement.

Notwithstanding the foregoing, nothing in this Agreement will restrict: (a) LicensorSupplier’s use of System Data or data derived from System Data that does not identify or permit, alone or in conjunction with other data, identification, association, or correlation of or with (i) BuyerPurchaser, its Affiliates, Users, customers, suppliers or other persons interacting with Buyer Purchaser and its Affiliates or any Confidential Information of BuyerPurchaser, or (ii) any device (e.g. computer, mobile telephone, or browser) used to access or use the Software Service as originating through Buyer Purchaser or its Affiliates or interacting with Buyer Purchaser or its Affiliates; or (b) either Party’s use of any data, records, files, content or other information related to any third party that is collected, received, stored or maintained by a Party independently from this Agreement.

Use of Other Data. Licensor will also maintain an administrative access to the system that is used in respective support cases.

Use of Other Data.
