Use of Settlement Fund Prior to the Effective Date. If the Settlement does not become final and effective for any reason, then Gilead will not owe the payment of the Settlement Fund except for any amounts reasonably incurred and billed by the Settlement Administrator, which shall be Gilead’s responsibility.
