Common use of Use of Surface or Subsurface Water Clause in Contracts

Use of Surface or Subsurface Water. Lessee is not permitted to use water from Lessor’s surface wells, ponds, lakes, springs, creeks, water courses or reservoirs on the Leased Premises without prior written consent and agreement with Lessor, separate from this Lease. Lessee shall not drill or operate any water well, take water, or inject any substance into the subsurface, or otherwise use or affect water in subsurface water formations.

Lessee shall not drill or operate any water well, take water, or inject any substance into the subsurface, subsurface (except fluid for hydrofracturing and/or drilling or completion operations) or otherwise use or affect water in subsurface water formationsformations on the Leasehold.
