Common use of User Selection of Vessel Agent or SOA Operator Clause in Contracts

User Selection of Vessel Agent or SOA Operator. A User may not and should not rely on the Operator and/or Authority allowing a SOA Operator or Vessel Agent the ability to operate under the terms of this Tariff or the Fee Schedule as an endorsement or statement by the Operator and/or the Authority of the ability of that party to perform the services the User may request. The selection of any Vessel Agent or SOA Operator is at the sole risk and responsibility of the User making that decision.

A User may not and should not rely on the Operator and/or Authority allowing qualifying and/or entering into a SOA Operator or Stevedore Operations Agreement and/or Vessel Agent the ability to operate under the terms of this Tariff or the Fee Schedule Agreement with any party as an endorsement or statement by the Operator and/or the Authority of the ability of that party to perform the services the User may request. The selection of any Vessel Agent or SOA Operator is at the sole risk and responsibility of the User making that decision.
