Common use of Utilities, Etc Clause in Contracts

Utilities, Etc. To Seller's Knowledge, all utilities and services necessary for the current use and operation of the Premises (including, without limitation, road access, gas, water, electricity and telephone) are available thereto and are of sufficient capacity to meet adequately all needs and requirements necessary for the current use and operation of the Premises. To Seller's Knowledge, no fact, condition or proceeding exists which would result in the termination or impairment of the furnishing of such utilities to the Premises.
