Common use of Utilities, Etc Clause in Contracts

Utilities, Etc. To Tenant's knowledge, all utilities and services necessary for the use and operation of the Leased Property (including, without limitation, road access, gas, water, electricity and telephone) are available thereto, are of sufficient capacity to meet adequately all needs and requirements necessary for the current use and operation of the Leased Property and for its intended purposes. To Tenant's knowledge, no fact, condition or proceeding exists which would result in the termination or material impairment of the furnishing of such utilities to the Leased Property.
