Utilization and Liability. The Association shall have the sole right to determine how Sick Leave Bank days shall be utilized and exceptions granted. In addition, the Association shall indemnify and hold harmless the Board from any and all claims arising from any and all decisions by the Association in relation to the use or denial of use of the Sick Leave Bank. This obligation to hold harmless shall only be applicable if the District gives the Association written notice within five (5) days of receipt of any charge, lawsuit or claim arising under this section.
