VA and Collaborator Contributions. The financial contributions of the Collaborator are set forth in the SOW. All payments by Collaborator shall be made to NPC and shall be in U.S. dollars by check or bank draft, sent in accordance with Section 13.16.4, or shall be made by electronic transfer. Collaborator’s failure to make any scheduled payment shall be deemed a material breach. If Collaborator fails to cure such breach within thirty (30) days, VA and NPC shall not be obligated to perform their responsibilities under this CRADA and may terminate this CRADA in accordance with the procedures set forth in Section 9.3. All remedies for such non-payment remain available to VA and NPC under Federal and state law.
