Common use of Valid Claim Clause in Contracts

Valid Claim. A claim of a patent or patent application that has not expired or been held invalid or unenforceable by a court of competent jurisdiction in a final and non-appealable judgment.

Valid Claim. A claim of an issued patent which claim has not lapsed, been canceled or become abandoned and has not been declared invalid by an unreversed and unappealable decision or judgment of a patent court or patent application other appropriate body of competent jurisdiction, and that has not expired or been held admitted to be invalid or unenforceable by a court of competent jurisdiction in a final and non-appealable judgmentthrough reissue or disclaimer.

Valid Claim. A a claim of a patent or patent application that which has been maintained and has not expired or and which has not been held declared invalid or unenforceable by a competent court of competent jurisdiction or authority in a final and non-appealable judgmentjudgment against which no appeal to a court or authority having mandatory jurisdiction is possible or the term for any such appeal has expired without the appeal being filed, or a pending claim of a patent application (unless an identical claim has been declared invalid or unenforceable in the same jurisdiction on a basis applicable to the pending claim).

Valid Claim. A claim of a from any issued patent or patent application that which has not expired been revoked or been held invalid or unenforceable by a decision of a court or other government agency of competent jurisdiction in a final and non-appealable judgmentjurisdiction, which decision is unappealable or unappealed within the time allowed for appeal.

Valid Claim. A claim of a an unexpired patent or pending patent application that has not expired or been held unpatentable, invalid or unenforceable by a court of competent jurisdiction in pursuant to a final and non-appealable judgmentunappealable decision of a court or other applicable administrative agency with appropriate Jurisdiction.
