VARIATION AND CANCELLATION. No agreement varying, adding to, deleting from or cancelling this agreement, shall be effective unless reduced to writing and signed by or on behalf of the parties.
VARIATION AND CANCELLATION. No agreement varying, adding to, deleting from or cancelling this agreement, and no waiver whether specifically, implicitly or by conduct of any right to enforce any term of this agreement, shall be effective unless reduced to writing and signed by or on behalf of the parties. It is recorded that there exists no collateral and/or other agreements and that this is the sole agreement entered into by and between the parties.
VARIATION AND CANCELLATION. 7.1 Sandvik has the right to direct variations in the Goods ordered without separate compensation to Supplier. Variations may include, but are not limited to, increases or decreases in the quantity, changes in Specifications and execution of the Goods or any part thereof, as well as changes in the delivery schedule. If such variation has a substantial effect for the costs of Supplier, a fair adjustment of the price may be made. If Sandvik has ordered variation of its Purchase Order, Supplier shall honor its obligations arising under the altered order within the delivery time originally provided, unless such variation reasonably requires that Supplier be allowed a later delivery date.
7.2 Sandvik may cancel the Agreement, partly or in its entirety, without reason at any time. Should Sandvik cancel the Agreement, partly or in its entirety, for convenience, Sandvik shall: (a) for Goods that are ready for delivery from Supplier, and which Supplier cannot reasonably reallocate to a third party, take delivery of such part of the Goods and pay the relevant parts of the agreed price set forth in the Agreement; (b) for Goods that are not ready for delivery from Supplier, and which Supplier cannot reasonably reallocate to a third party, pay Supplier’s proven direct costs for such Goods (or the relevant part thereof) prior to the cancellation; or (c) for Goods that Supplier reasonably can and is allowed to reallocate to a third party, be entitled to such cancellation without paying any part of the price for such Goods or incurring any costs.

VARIATION AND CANCELLATION. 27.3.1 No amendment, variation, or consensual cancellation of this Agreement, including an amendment to this clause 27.3, and no settlement of any disputes arising under this Agreement, will be binding unless recorded in writing and signed by the Parties.
27.3.2 For the purposes of this clause 27.3, “writing” will exclude any written document that is in the form, either wholly or partly, of a data message as defined in the Electronic Communications and Transactions Act 25 of 2002; as amended or substituted.
VARIATION AND CANCELLATION. 13.1 Any order may be varied or cancelled only if such variation or cancellation is accepted by the Seller in writing and any variation or cancellation by the Customer (whether or not is has been agreed to by the Seller) may only occur on terms which will provide for the Seller to be indemnified by the Customer for all costs incurred by the Seller to the date of cancellation. In the event of any variation being requested by the Customer during manufacture and agreed to by the Seller the contract price shall be adjusted accordingly by the agreed value of any such variation. The Seller reserves the right to extend the original delivery date by a reasonable period commensurate with the time deemed necessary to incorporate the variation(s) requested by the Customer. Cancellation charges shall be payable by the Customer in any case where the Seller agrees to the cancellation of any order in whole or in part.
VARIATION AND CANCELLATION. 18.1 This Agreement, the appendices, all references to terms and conditions contained on the Next Biosciences website and the explanatory terms as contained in the information booklet within the Collection Kit, constitute the entire Agreement between the parties and no warranties, representations or guarantees not contained or recorded herein shall be of any force or effect.
VARIATION AND CANCELLATION. 4.1. The Customer may vary the Customer Information, the quantities of a Subscription or any part thereof by notifying Misco. Subject to agreement by the Customer to pay any fees applicable required by the Vendor, Misco will affect the variation where possible in a timely manner. Misco cannot guarantee the Vendor will agree to such changes but will use best endeavours to achieve the variation.
4.2. Misco may, from time to time, amend this Agreement to reflect changes in relevant laws and regulatory requirements and changes imposed by the Vendor. Misco will provide no less than 30 days’ notice of any variation to this Agreement. The variation shall apply to all Agreements on the expiry of the notice (unless otherwise agreed between the parties).
VARIATION AND CANCELLATION. 7.1 We are entitled to vary or cancel the Event in Our sole discretion. If the Event is varied or cancelled and Your Presentation Submission is not displayed or You are unable to make Your Presentation at the Event, neither We nor the Host have/has any liability to You whatsoever for any costs or losses You incur, including but not limited to transportation or accommodation costs. We recommend that You consider making accommodation and transport arrangements that permit variation or cancellation with appropriate refunds. We further recommend that You obtain insurance that will reimburse You accommodation and transport costs in the event of cancellation.
VARIATION AND CANCELLATION. 9.1 We reserve the right to change the specifications of the goods provided that the end performance is not materially prejudiced.
9.2 If We are unable to provide the goods or services, then We may cancel Your order.
9.3 No purported cancellation by You is binding on Us.
