Common use of Variation of rights and cumulative remedies Clause in Contracts

Variation of rights and cumulative remedies. (a) The exercise of a right partially or on one occasion does not prevent any further exercise of that right in accordance with the terms of this document. Neither a forbearance to exercise a right nor a delay in the exercise of a right operates as an election between rights or a variation of the terms of this document. (b) The rights, powers and remedies provided to the Seller and Newcrest in this clause 16 are cumulative and not exclusive of any rights, powers or remedies provided at law or in equity or by any agreement, including this document.
