Common use of Variation Price Request Clause in Contracts

Variation Price Request. The Commonwealth's Representative may, at any time, issue a document titled "Variation Price Request" to the Consultant which will set out details of a proposed Variation which the Commonwealth is considering with respect to the Services. The Consultant must immediately take all action required under any relevant subcontract in relation to each subconsultant that would be involved in carrying out the proposed Variation. Within 14 days of the receipt of a "Variation Price Request", the Consultant must provide the Commonwealth's Representative with a written notice in which the Consultant sets out: the adjustment (if any) to the Fee to carry out the proposed Variation; and the effect (if any) which the proposed Variation will have on the then approved program. Variation Order Whether or not the Commonwealth's Representative has issued a "Variation Price Request" under clause 9.1, the Commonwealth's Representative may at any time instruct the Consultant to carry out a Variation by a written document titled "Variation Order", in which the Commonwealth's Representative will state one of the following: the proposed adjustment to the Fee as set out in the Consultant's notice under clause 9.1 (if any) is agreed and the Fee will be adjusted accordingly; or any adjustment to the Fee will be determined under clauses 9.3(b) and 9.3(c). No Variation will invalidate the Contract irrespective of the nature, extent or value of the services the subject of the Variation.
