Common use of Variations Between Agreements Clause in Contracts

Variations Between Agreements. Variations between requirements imposed on the Borrower by this Agreement and the Indenture and requirements imposed on the Borrower by the Regulatory Agreement, the Tax Certificate or the Mortgage shall not excuse or relieve the Borrower from full performance of this Agreement, the Indenture, the Mortgage, the Regulatory Agreement and the Tax Certificate. To the extent there are inconsistencies among said documents, the Regulatory Agreement and the Tax Certificate, as applicable, shall control with respect to maintaining the exclusion from gross income of interest on the Bonds, and the Indenture shall control with respect to all other matters.
