Various Affirmative Covenants of Tenant. Tenant covenants and agrees that Tenant will: (a) At any time and from time to time, but not more often than twice in any Lease Year, execute, acknowledge and deliver to Landlord, or to anyone Landlord shall designate, a tenant estoppel certificate in the form annexed hereto and made a part hereof as Exhibit “G” or other customary and reasonable form reasonably acceptable to financial institutions requesting the same relating to matters customarily included in tenant estoppel certificates within ten (10) days of receipt of Landlord’s request accompanied by such certificate. (b) Faithfully observe and comply with the rules and regulations annexed hereto and made a part hereof as Exhibit “C” and such reasonable additional rules and regulations as Landlord hereafter at any time or from time to time may communicate in writing to Tenant, and which, in the reasonable judgment of Landlord, shall be necessary or desirable for the reputation, safety, care or appearance of the Property, or the preservation of good order therein, or the operation or maintenance of the Property, or the equipment thereof, or the comfort of tenants or others in the Property; provided, however, that in the case of any conflict between the provisions of this Lease and any such rule or regulation, the provisions of this Lease shall control. Nothing contained in this Lease shall be construed to impose upon Landlord any duty or obligation to enforce the rules and regulations or the terms, covenants or conditions in any other lease as against any other tenant, and Landlord shall not be liable to Tenant for violation of any rule or regulation by any other tenant, its employees, agents, visitors, invitees, subtenants or licensees.

Nothing contained in this Lease shall be construed to impose upon Landlord any duty or obligation to enforce the rules and regulations or the terms, covenants or conditions in any other lease as against any other tenant, and Landlord shall not be liable to Tenant for violation of any rule or regulation by any other tenant, its employees, agents, visitors, invitees, subtenants or licensees. Notwithstanding the foregoing, Landlord shall not enforce such rules and regulations against Tenant, or fail to enforce the same against other tenants in the Building, in a manner which would be unreasonable and discriminatory as to Tenant.

To the extent that Landlord does enforce said rules and regulations, Landlord agrees to use all reasonable efforts to do so in a non-discriminatory manner.
