Common use of Virtual to Physical Collocation Relocation Clause in Contracts

Virtual to Physical Collocation Relocation. In the event physical collocation space was previously denied at a location due to technical reasons or space limitations, and physical collocation space has subsequently become available, WebShoppe may relocate its virtual collocation arrangements to physical collocation arrangements and pay the appropriate fees for physical collocation and for the rearrangement or reconfiguration of services terminated in the virtual collocation arrangement, as outlined in the appropriate BellSouth tariffs. In the event that BellSouth knows when additional space for physical collocation may become available at the location requested by WebShoppe, such information will be provided to WebShoppe in BellSouth’s written denial of physical collocation. To the extent that ( i) physical Collocation Space becomes available to WebShoppe within 180 calendar days of BellSouth’s written denial of WebShoppe’s request for physical collocation, (ii) BellSouth had knowledge that the space was going to become available, and (iii) WebShoppe was not informed in the written denial that physical Collocation Space would become available within such 180 calendar days, then WebShoppe may relocate its virtual collocation arrangement to a physical collocation arrangement and will receive a credit for any nonrecurring charges previously paid for such virtual collocation. WebShoppe must arrange with a BellSouth Certified Supplier for the relocation of equipment from its virtual Collocation Space to its physical Collocation Space and will bear the cost of such relocation.

In the event that BellSouth knows when additional space for physical collocation may become available at the location requested by WebShoppeTelCove, such information will be provided to WebShoppe TelCove in BellSouth’s written denial of physical collocationcollocation space. To the extent that ( (i) physical Collocation Space becomes available to WebShoppe TelCove within 180 calendar one hundred eighty (180) days of BellSouth’s written denial of WebShoppeTelCove’s request for physical collocation, (ii) BellSouth had knowledge that the space was going to become available, and (iii) WebShoppe TelCove was not informed in the written denial that physical Collocation Space would become available within such 180 calendar one hundred eighty (180) days, then WebShoppe TelCove may relocate its virtual collocation arrangement to a physical collocation arrangement and will receive a credit for any nonrecurring charges previously paid for such virtual collocation. WebShoppe TelCove must arrange with a BellSouth Certified Supplier for the relocation of equipment from its virtual Collocation Space to its physical Collocation Space and will bear the cost of such relocation.

In the event that BellSouth knows when additional space for physical collocation may become available at the location requested by WebShoppePowertel, such information will be provided to WebShoppe Powertel in BellSouth’s written denial of physical collocation. To the extent that ( (i) physical Collocation Space becomes available to WebShoppe Powertel within 180 calendar days of BellSouth’s written denial of WebShoppePowertel’s request for physical collocation, (ii) BellSouth had knowledge that the space was going to become available, and (iii) WebShoppe Powertel was not informed in the written denial that physical Collocation Space would become available within such 180 calendar days, then WebShoppe Powertel may relocate transition its virtual collocation arrangement to a physical collocation arrangement and will receive a credit for any nonrecurring charges previously paid for such virtual collocation. WebShoppe Powertel must arrange with a BellSouth Certified Supplier for the relocation of equipment from its virtual Collocation Space to its physical Collocation Space and will bear the cost of such relocation.

In the event that BellSouth knows when additional space for physical collocation may become available at the location requested by WebShoppeBTC, such information will be provided to WebShoppe BTC in BellSouth’s written denial of physical collocation. To the extent that ( (i) physical Collocation Space becomes available to WebShoppe BTC within 180 calendar days of BellSouth’s written denial of WebShoppeBTC’s request for physical collocation, (ii) BellSouth had knowledge that the space was going to become available, and (iii) WebShoppe BTC was not informed in the written denial that physical Collocation Space would become available within such 180 calendar days, then WebShoppe BTC may relocate transition its virtual collocation arrangement to a physical collocation arrangement and will receive a credit for any nonrecurring charges previously paid for such virtual collocation. WebShoppe BTC must arrange with a BellSouth Certified Supplier for the relocation of equipment from its virtual Collocation Space to its physical Collocation Space and will bear the cost of such relocation.

In the event that BellSouth knows when additional space for physical collocation may become available at the location requested by WebShoppeWinStar, such information will be provided to WebShoppe WinStar in BellSouth’s written denial of physical collocation. To the extent that ( i) physical Collocation Space becomes available to WebShoppe WinStar within 180 calendar days of BellSouth’s written denial of WebShoppeWinStar’s request for physical collocation, (ii) BellSouth had knowledge that the space was going to become available, and (iii) WebShoppe WinStar was not informed in the written denial that physical Collocation Space would become available within such 180 calendar days, then WebShoppe WinStar may relocate transition its virtual collocation arrangement to a physical collocation arrangement and will receive a credit for any nonrecurring charges previously paid for such virtual collocation. WebShoppe WinStar must arrange with a BellSouth Certified Supplier for the relocation of equipment from its virtual Collocation Space to its physical Collocation Space and will bear the cost of such relocation.

In the event that BellSouth knows when additional space for physical collocation may become available at the location requested by WebShoppeBBOC, such information will be provided to WebShoppe BBOC in BellSouth’s written denial of physical collocation. To the extent that ( (i) physical Collocation Space becomes available to WebShoppe BBOC within 180 calendar days of BellSouth’s written denial of WebShoppeBBOC’s request for physical collocation, (ii) BellSouth had knowledge that the space was going to become available, and (iii) WebShoppe BBOC was not informed in the written denial that physical Collocation Space would become available within such 180 calendar days, then WebShoppe BBOC may relocate transition its virtual collocation arrangement to a physical collocation arrangement and will receive a credit for any nonrecurring charges previously paid for such virtual collocation. WebShoppe BBOC must arrange with a BellSouth Certified Supplier for the relocation of equipment from its virtual Collocation Space to its physical Collocation Space and will bear the cost of such relocation.

In the event that BellSouth knows when additional space for physical collocation may become available at the location requested by WebShoppeKMC Telecom, such information will be provided to WebShoppe KMC Telecom in BellSouth’s written denial of physical collocation. To the extent that ( (i) physical Collocation Space becomes available to WebShoppe KMC Telecom within 180 calendar days of BellSouth’s written denial of WebShoppeKMC Telecom’s request for physical collocation, (ii) BellSouth had knowledge that the space was going to become available, and (iii) WebShoppe KMC Telecom was not informed in the written denial that physical Collocation Space would become available within such 180 calendar days, then WebShoppe KMC Telecom may relocate transition its virtual collocation arrangement to a physical collocation arrangement and will receive a credit for any nonrecurring charges previously paid for such virtual collocation. WebShoppe KMC Telecom must arrange with a BellSouth Certified Supplier for the relocation of equipment from its virtual Collocation Space to its physical Collocation Space and will bear the cost of such relocation.
