WAIVER AND CUMULATIVE REMEDIES. 37.1 The rights and remedies provided by this Framework Agreement may be waived only in writing by the Authority’s Representative or the Supplier’s Representative in a manner that expressly states that a waiver is intended, and such waiver shall only be operative with regard to the specific circumstances referred to. 37.2 Unless a right or remedy of the Authority is expressed to be an exclusive right or remedy, the exercise of it by the Authority is without prejudice to the Authority's other rights and remedies.
