Common use of Waiver and Delay Clause in Contracts

Waiver and Delay. No waiver or delay in enforcing the terms of this Agreement or in taking any action with respect to any breach of this Agreement shall be construed as a waiver of any subsequent breach. No action taken by the Indemnitee shall constitute a waiver of the Indemnitee's rights under this Agreement.
