WAIVER OF BUYER CONTRACT CONTINGENCIES. By executing this Lease, Xxxxx acknowledges that all provisions of the Contract which make Buyer’s obligations under the Resale Contract contingent are either satisfied or waived. In the event that Buyer fails to close on the purchase of the Property, the parties acknowledge that the Xxxxxxx Money tendered under the Resale Contract shall be disbursed per the terms of the Resale Contract.
