Waiver of Claims by Contractor. As of the date of the final certificate for payment, the Contractor expressly waives and releases the Owner from all claims against the Owner including without limitation those that might arise from the negligence or breach of contract by the Owner except: .1 those made in writing prior to the Contractor's application for final payment and still unsettled; and .2 those arising from the provisions of GC 9.2 - TOXIC AND HAZARDOUS SUBSTANCES or GC 10.3 - PATENT FEES.
