Waiver of Claims under the Age Discrimination in Employment Act. Executive In addition to the other provisions in this Agreement, Xxxxxxx acknowledges that the information in the following paragraphs is included for the express purpose of complying with the Older Workers’ Benefits Protection Act, 29 U.S. C. §626(f):
x. Xxxxxxx is over 40 years of age as of the Effective Date. Xxxxxxx realizes there are many laws and agrees that Executive is waiving any regulations prohibiting employment discrimination or otherwise regulating employment or claims under related to employment pursuant to which he may have rights or claims, including the Age Discrimination in Employment Act of 1967, as amended (the “ADEA”). Xxxxxxx hereby waives and releases any rights or claims he may have under the ADEA.
b. By signing this Agreement, as amended by the Older Workers Benefit Protection Act, and that:
a. Executive Xxxxxxx states that he is receiving compensation and severance benefits to which he was not otherwise entitled. Xxxxxxx hereby waives and releases all claims against Xxxxx Mart that Xxxxxxx may have based on his age. Xxxxxxx is not waiving any claim or action under the ADEA based upon rights or claims that may arise after the date Xxxxxxx signs this Agreement.
x. Xxxxxxx is being given the consideration which and benefits specified herein in exchange for the release and waiver of all claims that he is agreeing to herein. This consideration is in addition to anything of value to which Executive otherwise would have Xxxxxxx is already entitled. Xxxxxxx is receiving this consideration without having to perform services of an equal value.
x. Xxxxxxx has been entitled, including but not limited to the benefits set forth informed in Section 2;
b. Executive fully understands the terms of this Agreement and enters into it voluntarily, without any coercion on the part of any person or entity;
c. Executive was given adequate time to consider all implications and to freely and fully writing that he could consult with and seek the advice of whomever he deemed appropriate and has done so;
