In consideration for being permitted to participate in Quincy Community Theatre (hereinafter “QCT”) classes and/or for my children listed below to participate in QCT classes, the undersigned, on behalf of himself or herself and such participating children and any personal representatives, heirs or next of kin (hereinafter “the undersigned”) hereby acknowledges, agrees and represents that he or she has read the Safety Notice and Rules and will abide by them. The undersigned acknowledges that the novel coronavirus (“COVID-19”) has been confirmed throughout the United States, including positive cases in Quincy, Illinois, as well as surrounding areas. If any of the events listed in the “Positive COVID-19 Test Results, Symptoms, and/or Travel to High Impact Areas” occur in addition to following the rules set forth in that section, the undersigned will notify QCT immediately. The undersigned acknowledges and agrees that QCT may revise its procedures at any time based on updated recommended guidelines and protocols issued by public health agencies and further agrees to comply with said revised procedures prior to attending QCT classes. The undersigned fully understands and appreciates both the known and potential dangers of attending class at QCT and acknowledges that attendance thereof by the undersigned and/or participating children may, despite QCT’s reasonable efforts to mitigate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death of the participating student or those who come into contact with the participating student. IN FURTHER CONSIDERATION OF BEING PERMITTED TO ATTEND A QCT CLASS, THE UNDERSIGNED XXXXXX AGREES TO THE FOLLOWING: THE UNDERSIGNED, ON HIS OR HER BEHALF OR ON BEHALF OF SUCH PARTICIPATING CHILDREN, XXXXXX RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the Quincy Community Theatre (QCT), its directors, officers, employees, volunteers, and agents for all liability to the undersigned or such participating children for any loss or damage, and any claim or demands on account of any injury to, or an illness or the death of, the undersigned or such participating children (or any person who may contract COVID-19, directly or indirectly, from the undersigned or such participating children) whether caused by the negligence, active or passive, of the QCT or otherwise while the undersigned or such participating children are participating in any QCT programing. THE UNDERSIGNED XXXXXX AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Quincy Community Theatre (QCT), its directors, officers, employees, volunteers, and agents and each of them, from any loss, liability, damages, expenses, claims, lawsuits, judgements, or costs (including attorney fees) they may incur, whether caused by the negligence, active or passive, or otherwise while the undersigned or such participating children are participating in any QCT programing. The undersigned understands and agrees that QCT is not required to provide insurance to cover the undersigned or such participating children in the event they suffer illness, injury, death, or damage of any sort upon or about QCT premises while participating in any QCT program. THE UNDERSIGNED further expressly agrees that the foregoing ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT is governed by the laws of the State of Illinois and is intended to be as broad and inclusive as is permitted by the laws of the State of Illinois and if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. THE UNDERSIGNED acknowledges the provisions of this ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT will continue in full force and effect even after the undersigned or such participating children is no longer participating in a QCT program. WAIVER OF LIABILITY AND INDEMNITY AGREEMENT. In consideration Purpose of this Agreement. This document (for simplicity, referred to hereafter as the “Agreement”): • informs you of risks you may encounter in your upcoming photography tour, workshop, or class (hereafter, “Tour”): PATAGONIA – ARGENTINA AND CHILE Dates: April 11 – April 21, 2020 Minimum number of participants: 5 Maximum number of participants: 12 Tour Leader(s): Xxxxxx Xxxxx and Xxxxxxxxx Xxxxxxx • identifies which risks will be assumed by Road Runner Photography Tours, LLC (hereafter, “Road Runner”), and which risks will be assumed by you; • explains important terms and conditions regarding your registration and your participation in the Tour; • explains how this Agreement will be interpreted and applied in the event you experience an injury or loss; and • provides you the opportunity to negotiate an alternative agreement if there is anything in this document that you do wish to agree to. Road Runner requires this Agreement to ensure that you understand the risks that may be encountered during the Tour, to ensure an appropriate, equitable allocation of risks between you and Road Runner, and to ensure you understand important terms and conditions of the Tour. If we did not require this or a similar Agreement, we would have to set the fees for our tours at a much higher level, we would not be able to offer some tours, and some people would not be able to participate because the price would be prohibitively high. You benefit by being permitted able to participate in Quincy Community Theatre the Tour, and by enjoying a substantially lower cost to participate. This is a formal legal agreement. You need to take the time to read and understand its terms; do not sign this Agreement until you have done so. If you do not agree with any provision of the entire document, you may propose an alternative agreement (hereinafter “QCT”) classes and/or for my children listed below see Negotiation of an Alternative Agreement, below). Your Tour registration is not confirmed and you will not be allowed to participate in QCT classesthe Tour until: • you sign this Agreement and deliver it to Road Runner, or • you sign and deliver an alternative agreement to which Road Runner has agreed. Road Runner will continue to offer enrollment in this Tour until we have confirmed registrations for the undersigned, maximum number of participants we will permit on behalf of himself or herself and such participating children and any personal representatives, heirs or next of kin (hereinafter “the undersigned”) hereby acknowledges, agrees and represents that he or she has read the Safety Notice and Rules and will abide by them. I hereby waive, release, and discharge any and all claims for damages for death, personal injury, or property damage which I may have, or which hereafter accrue to me, against the Town of Xxxxxx as a result of my participation in the program and/or Travel to High Impact Areas” occur in addition to following the rules set forth in that sectionevent. I also agree for myself, and agents for all liability to the undersigned or such participating children for any loss or damagechild participant, to follow all rules and any claim or demands on account of any injury to, or an illness or the death of, the undersigned or such participating children (or any person who may contract COVID-19, directly or indirectly, from the undersigned or such participating children) whether caused by the negligence, active or passive, procedures of the QCT or otherwise while program and to follow the undersigned or such participating children are participating in any QCT programing. THE UNDERSIGNED XXXXXX AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS reasonable instructions of the Quincy Community Theatre (QCT), its directors, officers, employees, volunteers, teachers and agents and each supervisors of them, from any loss, liability, damages, expenses, claims, lawsuits, judgements, or costs (including attorney fees) they may incur, whether caused by the negligence, active or passive, or otherwise while the undersigned or such participating children are participating in any QCT programing. The undersigned understands and agrees that QCT is not required to provide insurance to cover the undersigned or such participating children in the event they suffer illness, injury, death, or damage of any sort upon or about QCT premises while participating in any QCT program. THE UNDERSIGNED further expressly agrees If I am registering a child for a program, I agree that the foregoing ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT is governed by the laws of the State of Illinois and is intended to be as broad and inclusive as is permitted by the laws of the State of Illinois and if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. THE UNDERSIGNED acknowledges the provisions of this ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT will continue in full force and effect even after the undersigned or such participating children is no longer participating in I am a QCT program. THE UNDERSIGNED acknowledges that he/she has read this ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT and understands he or she has given up substantial rights by signing it and signs the ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT voluntarily.
