Common use of Waiver of Lis Pendens Clause in Contracts

Waiver of Lis Pendens. It is expressly understood and agreed by Sonnenblick that no lis pendens shall be filed against any portion of the Site with respect to this Agreement or any dispute or act arising from it. Sonnenblick acknowledges that the City is not authorized to mortgage or encumber the Site as collateral for the Development or any other purpose and agrees not to cause or permit any cloud to be filed or recorded against the title of the Site other than a long term ground lease lawfully approved by the City. This covenant shall survive termination of this Agreement by lapse of time or otherwise.
