Common use of WAIVER OF MARSHALING RIGHTS Clause in Contracts

WAIVER OF MARSHALING RIGHTS. Trustor, for itself and for all parties --------------------------- claiming through or under Trustor, and for all parties who may acquire a lien on or interest in the Property, waives all rights to have the Property or any other property that is now or later may be security for any Obligation ("OTHER PROPERTY") marshaled on any foreclosure of this Deed of Trust or on a foreclosure of any other security for any of the Obligations. Beneficiary will have the right to sell, and any court in which foreclosure proceedings may be brought will have the right to order a sale of, the Property and any of the Other Property as a whole or in separate parcels, in any order that Beneficiary may designate.
