Common use of Waiver of Statutory Rights Clause in Contracts

Waiver of Statutory Rights. Leasehold Mortgagor shall not apply for or avail itself of any appraisement, valuation, redemption, stay, extension, or exemption laws, or any so-called “moratorium laws,” now existing or hereafter enacted, in order to prevent or hinder the enforcement or foreclosure of this Leasehold Mortgage, and Leasehold Mortgagor hereby waives the benefit of such laws. Leasehold Mortgagor, for itself and all who may claim through or under it, waives any and all rights to have the Property and estates comprising the Property marshaled upon any foreclosure of the lien of this Leasehold Mortgage, and agrees that any court having jurisdiction to foreclose such lien may order the Property sold in its entirety. Leasehold Mortgagor further waives any and all rights of redemption from foreclosure and from sale under any order or decree of foreclosure of the lien created by this Leasehold Mortgage, for itself and on behalf of: (i) any trust estate of which the Leased Premises are a part; (ii) all beneficially interested persons; (iii) each and every person acquiring any interest in the Property or title to the Leased Premises subsequent to the date of this Leasehold Mortgage; and (iv) all other persons to the extent permitted by the provisions of laws of the State in which the Leased Premises are located.

Leasehold Mortgagor further waives does hereby expressly waive any and all rights of redemption from foreclosure and from sale under any order order, judgment or decree of foreclosure of the lien created by this Leasehold Mortgage, for itself and Mortgage on behalf of: (i) any of Mortgagor, the trust estate of which the Leased Premises are a part; (ii) and all persons beneficially interested persons; (iii) therein, and each and every person acquiring any interest in the Property or title to the Leased Premises subsequent to the date of this Leasehold Mortgage; . Mortgagor hereby represents and (iv) warrants to Mortgagee that it has been directed in writing by the appropriate beneficiaries and holders of the power of direction of the trust estate to expressly waive all other persons rights of redemption to the Premises and reinstatement of the loan secured hereby in the manner herein set forth. Mortgagor does hereby further expressly waive, to the extent now or hereafter permitted by the provisions law, all rights of laws reinstatement of this Mortgage pursuant to Section 15-1602 of the State in which the Leased Premises are locatedAct.

In the event any waiver set forth herein could be deemed to limit Mortgagee's rights hereunder or under the Relevant Documents, including any rights to a deficiency judgment, such waiver shall be deemed void and (iv) all other persons to the extent permitted by the provisions of laws of the State in which the Leased Premises are locatedno further force and effect.

Leasehold Mortgagor, for itself and all who may claim through or under it, waives any and all rights right to have the Property property and estates comprising the Property Leasehold Premises marshaled upon any foreclosure of the lien of this Leasehold Mortgage, hereof and agrees that any court having jurisdiction to foreclose such lien may order the Property Leasehold Premises sold in its as an entirety. Leasehold To the extent permitted by law, Mortgagor further waives does hereby expressly waive any and all rights of redemption from foreclosure and from sale under any order or decree of foreclosure of the lien created by this Leasehold Mortgage, for itself and Mortgage on behalf of: (i) any of Mortgagor, the trust estate of which the Leased Premises are a part; (ii) and all persons beneficially interested persons; (iii) therein and each and every person person, acquiring any interest in the Property or title to the Leased Leasehold Premises subsequent to the date of this Leasehold Mortgage; . Such waiver is intended to be made in accordance with the provisions to 735 ILCS 5/15 1601 et seq. of the Mortgage Foreclosure Act, and (iv) all other persons to the greatest extent permitted by the provisions applicable law, is to be deemed to be a waiver of laws any and all rights of the State reinstatement and redemption (including, without limitation, all rights of reinstatement provided for in which the Leased Premises are located735 ILCS 5/15 1602 or redemption from sale provided for in 735 ILCS 5/15 1603).
