WAIVER OF TRIAL BY JURY, NO COUNTERCLAIMS. Both Landlord ant Tenant waive trial by jury in any action, proceeding or counterclaim brought by either party against the other (except for personal injury or property damage) on any matters whatsoever concerning the Lease, the relationship of Landlord and Tenant, or Tenant’s use or occupancy of the Apartment. It is further agreed that in the event Landlord commences any dispossess proceedings against Tenant, no counterclaim of Tenant based upon any claim against Landlord will be brought by Tenant in such proceeding.
