Common use of WAIVER OF TRIAL Clause in Contracts

WAIVER OF TRIAL. It is mutually agreed between Department and Concessionaire that they hereby waive trial by jury in any action, proceeding, or counterclaim brought by either against the other on any matters whatsoever arising out of or in any way connected with this Agreement or the relationship of Department and Concessionaire, Concessionaire’s use or occupancy of the Concession Premises, and/or any claim of injury or damage thereto or arising therefrom.

It is mutually agreed between Department and Concessionaire Operator that they hereby waive trial by jury in any action, proceeding, or counterclaim brought by either against the other on any matters whatsoever arising out of or in any way connected with this Agreement or the relationship of Department and ConcessionaireOperator, ConcessionaireOperator’s use or occupancy of the Concession PremisesOperation Area, and/or any claim of injury or damage thereto or arising therefrom.

It is mutually agreed between Department and Concessionaire that they hereby waive trial by jury in any action, proceeding, or counterclaim brought by either of the parties hereto against the other on any matters whatsoever arising out of or in any way connected with this Agreement or the relationship of the Department and Concessionaire, the Concessionaire’s use or occupancy of the Concession Premises, and/or any claim of injury or damage thereto or arising therefromof damage.

It is mutually agreed by and between Department and Concessionaire Operator that they hereby waive trial by jury in any action, proceeding, or counterclaim brought by either of the parties hereto against the other on any matters whatsoever arising out of or in any way connected with this Agreement or Agreement, the relationship of Department and ConcessionaireOperator, Concessionaire’s the Operator's use or occupancy of the Concession PremisesPark Property, and/or any claim of injury or damage thereto or arising therefromdamage.
