Common use of WAIVER OF TRIAL Clause in Contracts

WAIVER OF TRIAL. It is mutually agreed between Department and Licensee that they hereby waive trial by jury in any action, proceeding, or counterclaim brought by either against the other on any matters whatsoever arising out of or in any way connected with this Agreement or the relationship of Department and Licensee, Licensee’s use or occupancy of the Licensed Premises, and/or any claim of injury or damage thereto or arising therefrom.
