Waiver Precondition. The obligation to pay any amounts due under this Section or Section 9 below, if applicable, shall be subject to and conditioned upon Executive timely signing, delivering and not revoking a comprehensive and legally enforceable waiver and release all claims Executive has or may have against the Corporation, the Bank or any Affiliate, or any of their then current or former officers, directors, or employees.
