WAIVER PROVISION. The parties acknowledge that, during the negotiations which resulted in this Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to any subject or matter not removed by law from the area of collective bargaining, and that the understandings and agreements arrived at by the parties after the exercise of that right and opportunity are set forth in this Agreement. Therefore, the Employer and the Union, for the life of this Agreement, each voluntarily and unqualifiedly waives the right, and each agrees that the other shall not be obligated, to bargain collectively with respect to any subject or matter.
WAIVER PROVISION. A. The Association and the Committee agree that each has had a right to bargain for any provision that they wished in this contract and on matters that were or could have been discussed during negotiation except where otherwise provided in the contract each expressly waives the right to reopen the contract for any further demands or proposals and agrees that the present contract constitutes a complete agreement on all matters and that if other proposals have been made, they have been withdrawn in consideration of this Agreement.
B. If any provision of this Agreement or any application of the Agreement to any employee or group of employees shall be found contrary to law, then such provision or application shall not be deemed valid and subsisting, except to the extent permitted by law, but all other provisions or applications shall continue in full force and effect.
WAIVER PROVISION. The failure of Landlord to insist on strict performance of any of the terms, conditions and covenants herein shall not be deemed to be a waiver of any rights of remedies that Landlord may have and shall not be deemed a waiver of any subsequent breach in the terms, conditions and covenants herein contained except as may expressly waived.

WAIVER PROVISION. Effective July 1, 2012, provided eight (8) or fewer employees waive medical insurance, the cash payment for opting out shall be three thousand dollars ($3,000.00) per employee per plan year. If nine (9) or more employees participate in this waiver plan, the waiver payment shall be six thousand dollars ($6,000.00) per employee per plan year. The amount of this payment is not dependent upon whether the employee is eligible for single, parent/child, employee/spouse, or family benefits. Employees opting to waive dental insurance will receive five hundred dollars ($500.00) per plan year for making that selection. Employees must show proof of alternate coverage should they wish to take advantage of these payments. The payments will be made in two installments in December and June. The Board shall maintain a Section 125 Plan.
WAIVER PROVISION. In the event of circumstances beyond the control of the City, such as acts of God, fire, flood, insurrection, civil disorder, national emergency, or similar circumstances, provisions of the Memorandum of Understanding, which restrict the City’s ability to respond to these emergencies, shall be suspended for the duration of such emergency. After the emergency is declared over, the IPMA shall have the right to meet and confer with the City regarding the impact on employees of the suspension of these provisions in the Memorandum of Understanding.
WAIVER PROVISION. In the event of circumstances beyond the control of the City, such as acts of God, fire, flood, insurrection, civil disorder, national emergency, or similar circumstances, provisions of this MOU or the Personnel Rules or Regulations of the City, which restrict the City’s ability to respond to these emergencies, shall be suspended for the duration of such emergency. After the emergency is over, the Union shall have the right to meet and confer with the City regarding the impact on employees of the suspension of these provisions in the MOU and any Personnel rules and policies.
WAIVER PROVISION. The failure or omission of the Landlord to enforce provisions of this lease for any cause given above shall not negate the right of the Landlord to do so later for similar or other causes.
WAIVER PROVISION. The failure or omission of the Management to enforce provisions of this lease for any cause stated in the above sections shall not destroy the right of the Management to do so later for similar or other causes.
WAIVER PROVISION a. All insurance policies (other than worker's compensation insurance) which Tenant must carry pursuant to Article VIII of this Lease shall contain one of the following provisions and/or endorsements ("Waiver Provision"):
(i) An express waiver of any right of subrogation by the insurance company against Landlord, Landlord's Property Manager, Landlord's Mortgagee, and its agents and employees; or
(ii) A statement that the policy shall not be invalidated should the insured waive in writing, prior to a loss, any or all rights of recovery against any party for losses covered by such policies.
b. Any property insurance of Landlord covering the Premises shall also contain a Waiver Provision in one of the alternative forms provided in subsection 14.2(a), above; provided, this clause shall not cause Landlord to be obligated to secure any insurance over and above what is specifically contemplated herein. Any increased premium cost incurred by Landlord by reason of such Waiver Provision shall be paid by Tenant, provided, however, if Landlord is unable to obtain a waiver of subrogation from its insured, then any agreement to obtain such a waiver shall be null and void.
