Common use of Waiver to be Written Clause in Contracts

Waiver to be Written. No term or provision of this Contract shall be considered as waived by any Party unless a waiver is given in writing by that Party. Extent of Waiver No waiver under clause 68.1 (Waiver to be Written) shall be a waiver of a past or future default or breach nor shall it amend, delete or add to the terms, conditions or provisions of this Contract unless (and then only to the extent) expressly stated in that waiver.
