Common use of Waives Clause in Contracts

Waives. (1) protest of all commercial paper at any time held by the Bank on which Borrower, SARC, ARC Financial, SARC/Asheville or Surgery Center is in any way liable; and (2) notice and opportunity to be heard, after acceleration in the manner provided in Paragraph 8.2, before exercise by the Bank of the remedies of self-help, set-off, or of other summary procedures permitted by any applicable Laws or by any agreement with Borrower, SARC, ARC Financial, SARC/Asheville or Surgery Center, and, except where required hereby or by any applicable Laws, notice of any other action taken by the Bank; and
