Common use of WARRANTIES AS TO TITLE AND FITNESS FOR USE Clause in Contracts

WARRANTIES AS TO TITLE AND FITNESS FOR USE. Lessor, upon the effective date of this Lease, warrants that: (i) it is the true and lawful owner of the Premises; and (ii) it has good, right and full power to lease the same in the manner aforesaid. Except for the foregoing, this Lease is made without warranty of any kind, express or implied, as to the fitness of the Premises, for any particular use or purpose, and by executing this Lease, Lessee shall be deemed to have: (i) accepted the Premises; (ii) acknowledged that the same are in the condition called for hereunder; and (iii) agreed that the obligations of Lessor imposed hereunder have been fully performed.
