Common use of Warranties by Ikaria Clause in Contracts

Warranties by Ikaria. Ikaria warrants to Pulse Technologies that each Device delivered hereunder shall conform in all material respects with its applicable Specifications. Pulse Technologies agrees that its exclusive remedies, and Ikaria’s sole liabilities, with respect to any breach of the warranty set forth in this Section 5.2 are set forth in Section 2.8 of this Agreement.

Ikaria warrants to Pulse Technologies that each Device the Product delivered hereunder shall (a) conform in all material respects with its applicable SpecificationsSpecifications and (b) be manufactured in compliance applicable law (including applicable cGMPs). Pulse Technologies agrees that its exclusive remedies, and Ikaria’s sole liabilities, with respect to any breach of the warranty set forth in this Section 5.2 7.2 are set forth in Section 2.8 5(b) of this Agreement.
