Common use of Warranty as to Title Clause in Contracts

Warranty as to Title. The Delivering Participant warrants to the Receiving Participant that: (a) all gas that the Delivering Participant makes available for delivery in accordance with its obligations under this agreement will, when made available for delivery at the Delivery Point, be free from all liens, charges, encumbrances and adverse claims; and (b) the Delivering Participant will ensure that title to all gas that it makes available for delivery in accordance with its obligations under this agreement will transfer to the Buyer on delivery at the Delivery Point.
