Common use of Warranty by Developer Clause in Contracts

Warranty by Developer. In accordance with Section 17.21.080 of the Fruita Municipal Code, the Developer shall warrant any and all required improvements constructed by Developer pursuant to this Agreement and the Subdivision Final Plat and all accompanying documents, drawings, and plans for a period of twenty-four (24) months from the date the City certifies that the same conform with the approved specifications. The warranty period begins on the day City Council approves the Partial Release of Security per subsection 9.5 below. In addition, but not by way of limitation, the Developer shall warrant the following: 5.4.1 The Developer shall warrant that the title conveyed shall be good and its transfer rightful; and 5.4.2 The Developer shall warrant any and all facilities conveyed shall be free from any security interest or other lien or encumbrance. 5.4.3 The Developer shall warrant that any and all facilities so conveyed shall be free of any and all defects in materials or workmanship.
